Illinois Appellate Court Affirms Client’s Dismissal from Construction Defect Case

The Illinois Appellate Court has issued an opinion affirming Pretzel & Stouffer attorney Matthew Egan’s client’s dismissal from a construction defect case involving the south campus of the University of Illinois-Chicago. The suit alleged that the contractor client was liable for more than $850,000 in damages. Both the Cook County Circuit Court and the Illinois Appellate Court agreed with Mr. Egan’s argument that the client’s contract with the university did not provide a basis for imposing a duty to supervise and approve the work of another contractor on the job site.
