Illinois Appellate Court Affirms Client’s Dismissal from Construction Defect Case

The Illinois Appellate Court has issued an opinion affirming Pretzel & Stouffer attorney Matthew Egan’s client’s dismissal from a construction defect case involving the south campus of the University of Illinois-Chicago. The suit alleged that the contractor client was liable for more than $850,000 in damages. Both the Cook County Circuit Court and the Illinois Appellate Court agreed with Mr. Egan’s argument that the client’s contract with the university did not provide a basis for imposing a duty to supervise and approve the work of another contractor on the job site. This is an important decision for any attorney defending construction design or testing professionals in tort litigation.
