Defense Victory for Physicians in Bacterial Meningitis Death Case Upheld on Appeal

Robert Chemers and Scott Howie won a significant appeal in a case involving the death of a 26-year-old pregnant female in an emergency room when her bacterial meningitis was not diagnosed over a period of 12 hours. Brian T. Henry and D. Scott Rendleman defended three of the six physicians sued and obtained a jury verdict in their favor after a three-week trial. Mr. Chemers and Mr. Howie were successful during the appeal in convincing the appellate court to affirm the jury’s verdict, despite the claim by the plaintiff’s counsel that prejudicial errors occurred during jury selection.
