Pretzel & Stouffer Wins Summary Judgment for Psychiatrist in Negligence Case

Pretzel & Stouffer attorney Amy Thompson recently secured summary judgment in favor of her client, a psychiatrist, in a medical negligence case. The plaintiff, who suffered from schizoaffective disorder, began refusing his antipsychotic medications and later committed an assault. The plaintiff alleged that the physician should have obtained an order to medicate him against his will and that he would not have committed the assault if he had received the proper medication. Ms. Thompson’s successful motion for summary judgment stated that the plaintiff failed to prove damages, the plaintiff’s expert was unqualified to testify at trial and the plaintiff did not establish proximate cause.
