Homeowner Wins Binding Arbitration against Injured Guest

Richard Waris and Tom Draths recently achieved a defense award in a claim submitted to binding arbitration. Richard and Tom successfully defended a homeowner whose overnight guest sustained injuries near his summer home. When it became clear that the injured party’s six-figure medical bills exceeded the limits of the homeowner’s insurance policy, Richard and Tom developed a creative strategy to ensure that their client’s personal assets were not at stake while still having an opportunity to defend the alleged claim on its merits. The parties agreed to binding arbitration of the matter and, after a 14-hour arbitration hearing, the tri-panel of arbitrators returned an award for the homeowner.
