Pretzel & Stouffer Wins Summary Judgment for Physician in Wrongful Death Suit

Pretzel & Stouffer attorney Daniel B. Mills recently obtained summary judgment for a family practice physician in a wrongful death suit in Cook County. The physician was accused of using an ineffective antibiotic to treat a patient’s presumed pneumonia, resulting in the patient’s worsening infection, sepsis, and death. The plaintiff resisted summary judgment, maintaining that the motion was premature because the court had not set an expert disclosure deadline. Mills successfully argued that summary judgment was appropriate, however, based on the facts obtained during depositions. The case continues against the hospital and the infectious disease physician that cared for the patient.
