Pretzel & Stouffer Attorneys Successfully Thwart Bid For Entry of TRO

Pretzel & Stouffer partner, Jim Sipchen and associates Matt Tibble and Donald Patrick Eckler successfully opposed a motion for entry of a temporary restraining order filed by a book distribution company against its former sales representative and a competitor asserting violations of an alleged non-compete agreement and tortious interference with business relations. With less than 24 hour notice prior to the hearing, Jim, Matt and Pat were able to gather evidence and develop legal arguments that enabled them to establish at the hearing that plaintiff could not make a clear showing that the alleged non-compete remained in force and effect and a likelihood of success on the merits in the case.
